Terms and Conditions

Welcome to AnchorBullion.com (hereinafter referred to as “Anchor Bullion,” “we,” “us,” or “our”). These Terms and Conditions (the “Terms”) govern your access to and use of our website and any related services (collectively, the “Services”), including all orders, sales, and purchases (“Transactions”).

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services. You will be unable to place an order without expressly consenting to these Terms.

IMPORTANT: PLEASE READ THESE TERMS CAREFULLY. SECTION 17 CONTAINS A BINDING ARBITRATION AGREEMENT AND CLASS ACTION WAIVER, WHICH REQUIRES THAT DISPUTES BE RESOLVED BY FINAL AND BINDING ARBITRATION ON AN INDIVIDUAL BASIS, NOT ON A CLASS-WIDE BASIS. YOU AGREE TO WAIVE YOUR RIGHT TO A JURY TRIAL OR TO PARTICIPATE IN A CLASS ACTION. IF YOU DO NOT AGREE, YOU MAY OPT OUT OF ARBITRATION BY FOLLOWING THE INSTRUCTIONS IN SECTION 17.

ALL CUSTOMER CANCELLATIONS, RETURNS, AND DEFAULTS ARE SUBJECT TO OUR MARKET LOSS POLICY AS SET FORTH IN SECTION 5.


 

1. Acceptance of Terms and Eligibility

 

1.1. Binding Agreement: These Terms constitute a binding legal agreement between you (“User” or “you”) and Anchor Bullion. By using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms.

1.2. Updates to Terms: We may update these Terms at any time. The most current version will be posted on our website with the "Effective Date" updated. Your continued use of our Services after changes are posted constitutes your acceptance of those changes.

1.3. Eligibility: You must be at least 18 years of age to use our Services. By using the Services, you represent and warrant that you meet this requirement and will comply with all applicable local, state, national, and international laws regarding your use of the Services. The Services are intended for residents of the United States only.


 

2. Account Registration and Security

 

2.1. Creating an Account: To access certain features, you must create an account. You agree to provide accurate, current, and complete information and to update this information if it changes. If you use the Services on behalf of a company, you represent that you have the authority to bind that entity to these Terms.

2.2. Account Security: You are responsible for maintaining the confidentiality of your account password and for all activities that occur under your account. You agree to use a strong, unique password. You must notify us immediately of any suspected unauthorized use of your account. Anchor Bullion is not liable for any loss arising from your failure to protect your account credentials.


 

3. Ordering from Anchor Bullion (Sales Orders)

 

3.1. Placing Orders: All orders are subject to our acceptance. We reserve the right, at our sole discretion, to refuse or cancel any order for any reason, including but not limited to product availability, pricing errors, or suspicion of fraud.

3.2. Pricing:

  • Real-Time Pricing: Precious metal prices fluctuate with the market. The price for a product is not confirmed until your order is finalized at checkout, at which point it is locked in.

  • Price Confirmations: Once your order is confirmed with an order number, the price is locked in. Your payment must be remitted within the timeframes specified below to secure this price.

3.3. Payment:

  • Payment Methods: We accept payment by credit/debit card, bank wire, Automated Clearing House (ACH)/eCheck, personal check, cashier's check, money order, and cryptocurrency. Available methods may vary based on the order total.

  • Payment Deadlines: To secure your locked-in price, your payment must be initiated promptly:

    • Bank Wire: Payment must be received within 2 business days.

    • Checks/Money Orders: Payment must be postmarked within 1 business day and received by us within 10 calendar days.

    • All other methods: Payment must be completed at the time of order.

  • Holding Periods: Orders paid by check or ACH/eCheck are subject to a holding period of up to 10 business days to allow funds to clear before shipment.

  • Returned Payments: A $35 fee will be charged for any returned check or failed ACH payment. We reserve the right to cancel the order, subject to our Market Loss Policy (Section 5).


 

4. Selling to Anchor Bullion ("Sell-to-Us" Program)

 

4.1. General: We may purchase certain precious metal products from you. The sole relationship is that of a seller and purchaser. We reserve the right to refuse any offer to sell products to us at our discretion. A valid credit card is required to be on file to lock in a Sell-to-Us price to cover potential Market Loss fees.

4.2. Procedure:

  • Initiating a Sale: Contact us by phone or email to receive a quote for your items. The quote is based on your representations of the items' type, purity, and weight, and the current spot prices.

  • Locking in Price: Once you accept our offer, the price is locked in, and you will receive a confirmation number. This creates a binding contract.

  • Shipping to Us: You must ship the items to us within 2 business days of locking in the price. You are responsible for all shipping and insurance costs. All risk of loss is yours until the items are physically received and signed for by Anchor Bullion. We recommend using a trackable shipping method.

  • Inspection: Upon receipt, we will inspect the items for authenticity, weight, and condition. If the items do not conform to your representations, we reserve the right to make a revised offer or reject the transaction. If you decline a revised offer, we will return the items to you at your expense.

4.3. Cancellation: If you fail to ship your items within the required timeframe or if the items are not as described, we may cancel the transaction. All cancellations of Sell-to-Us orders are subject to our Market Loss Policy (Section 5).


 

5. Market Loss Policy

 

When you place a Transaction (either buying from us or selling to us), you enter a binding contract, and the price is locked. If you default on this contract by failing to make payment, failing to ship items, or requesting a cancellation, you are responsible for any resulting market loss we incur.

  • Definition of Market Loss: Market Loss is the difference in value if the market price of the precious metals has moved against the locked-in price of your transaction.

    • For a Sales Order (you buying from us), market loss occurs if the spot price is lower at the time of cancellation than your locked-in price.

    • For a Sell-to-Us Order (you selling to us), market loss occurs if the spot price is higher at the time of cancellation than your locked-in price.

  • Cancellation Fee: In the event of any cancellation or default, you agree to pay a cancellation fee of $35.00 plus any applicable Market Loss.

  • Collection: You authorize Anchor Bullion to charge the credit card on file for these fees. If the charge is unsuccessful, you agree to pay the invoiced amount within 10 business days.

  • Market Gain: Any market gains resulting from a canceled order shall remain the sole property of Anchor Bullion.


 

6. Shipping, Delivery, and Insurance

 

6.1. Shipment of Your Order: We will ship products to the address you provide. High-value orders will require a signature upon delivery.

6.2. Risk of Loss and Insurance: We insure all shipments during transit. Our responsibility and insurance coverage ends once the package is marked as "Delivered" by the carrier to the provided address.

  • You assume all risk of loss once the package is delivered.

  • We are not responsible for losses if you have instructed the carrier to leave a package without a signature, or if the package is delivered to a third party (e.g., mailroom, neighbor, freight forwarder).

  • Reporting Issues: You must notify us of any issues with your shipment within the following timeframes:

    • Damaged or Missing Items: Within 48 hours of delivery.

    • Lost in Transit: Within 7 calendar days of the last tracking update.

  • You agree to cooperate fully with any insurance claim process, including filing police reports and signing affidavits if required. Failure to cooperate may void insurance coverage.

6.3. International Shipping: If we offer international shipping, you are responsible for all customs duties, taxes, and fees. We are not responsible for items delayed or confiscated by customs.


 

7. Returns and Cancellations

 

7.1. Return Policy: Due to market volatility, all sales are final. We do not accept returns except in cases where we shipped the wrong or a damaged item.

7.2. Damaged or Incorrect Items: If you receive a damaged or incorrect item, you must notify us within 5 business days of receipt. We may require photographic evidence. At our discretion, we will either replace the item or provide a refund.

7.3. Cancellations: You may not cancel a confirmed order. However, you may request to offset your order by selling the items back to us at our current price. All such requests are at our sole discretion and are subject to our Market Loss Policy (Section 5).


 

8. Intellectual Property

 

All content on AnchorBullion.com, including text, graphics, logos, and software, is the property of Anchor Bullion or its licensors and is protected by intellectual property laws. You are granted a limited, non-exclusive license to access the content for personal, non-commercial use only.


 

9. Prohibited Activities

 

You agree not to use our Services for any unlawful purpose, including but not limited to fraud, money laundering, or terrorist financing. You may not use automated systems (robots, spiders) to access our site or interfere with the security and integrity of our Services.


 

10. Disclaimer of Warranties

 

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” ANCHOR BULLION MAKES NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.


 

11. Limitation of Liability

 

TO THE FULLEST EXTENT PERMITTED BY LAW, ANCHOR BULLION SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES. OUR TOTAL LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING FROM YOUR USE OF THE SERVICES SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID TO US IN THE SIX (6) MONTHS PRECEDING THE CLAIM.


 

12. Indemnification

 

You agree to indemnify, defend, and hold harmless Anchor Bullion and its affiliates from any claims, liabilities, damages, and expenses (including reasonable attorneys’ fees) arising from your use of the Services, your violation of these Terms, or your infringement of any law or the rights of a third party.


 

13. Privacy Policy

 

Your use of the Services is also subject to our Privacy Policy, which is incorporated herein by reference.


 

14. Termination

 

We reserve the right, in our sole discretion, to terminate or suspend your account and access to the Services at any time, without notice, for any reason, including for a violation of these Terms.


 

15. Governing Law

 

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of laws principles.


 

16. Dispute Resolution by Binding Arbitration

 

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.

16.1. Agreement to Arbitrate: You and Anchor Bullion agree that any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Services (a "Claim") will be resolved by binding arbitration, rather than in court. The Federal Arbitration Act governs the interpretation and enforcement of this section.

16.2. No Class Actions: ALL CLAIMS MUST BE BROUGHT IN THE PARTIES' INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS ACTION, COLLECTIVE ACTION, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a representative or class proceeding.

16.3. Arbitration Rules: The arbitration will be administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The arbitration will be held in New Castle County, Delaware, or at another mutually agreed location.

16.4. Opt-Out of Arbitration: You have the right to opt out of this arbitration agreement. To opt out, you must notify Anchor Bullion in writing within 30 days of the date you first became subject to this arbitration provision. You must email your notice to [legal@anchorbullion.com] with the subject line "Arbitration Opt-Out" and include your full name and address.

16.5. Pre-Arbitration Notice: Before initiating arbitration, you agree to first send a written notice of your Claim to our legal department. If we cannot resolve the Claim within 60 days of receiving the notice, either party may commence arbitration.

16.6. Coordinated Claims: If 25 or more similar arbitration demands are asserted against Anchor Bullion by the same or coordinated counsel, we may implement a "bellwether" process, wherein a small number of cases are arbitrated to help resolve the remaining claims efficiently.


 

17. General Provisions

 

17.1. Entire Agreement: These Terms and our Privacy Policy constitute the entire agreement between you and Anchor Bullion.

17.2. Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

17.3. No Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
